Terms and Conditions of Use
I. Introduction
This Terms and Conditions Agreement ("Agreement") governs the access to and use of the GymFinder application ("Application"), which facilitates the connection between gym owners and clients for temporary gym sessions. By accessing or using the Application, you (each, a "User") agree to be bound by this Agreement. If you do not agree with any provision herein, you must refrain from using the Application.
II. Definitions
User: Any individual or legal entity that accesses or uses the Application.
Gym Owner: Any individual or legal entity that has registered a gym within the GymFinderManager system and maintains an active account.
III. Disclaimer of Liability
The Application is provided solely as an intermediary platform to connect Gym Owners with Users.
GymFinder does not warrant or guarantee the quality, safety, or suitability of any gym listed or any services provided therein.
Under no circumstances shall GymFinder be liable for any personal injury, property damage, or financial loss incurred directly or indirectly from the use of the Application or attendance at any gym.
Users and Gym Owners acknowledge and assume all risks associated with the use of the Application.
IV. User Account and Information
Users agree to provide accurate, current, and complete information during the registration process.
GymFinder reserves the right to suspend or terminate any account that contains false, misleading, or inaccurate information, at its sole discretion.
Gym Owner Account Deletion
If a Gym Owner elects to delete his or her account in the GymFinderManager application, the corresponding account in the GymFinder client application will be automatically deleted.
All funds remaining in the GymFinderManager account at the time of deletion shall be irretrievably forfeited.
User Account Deletion Restriction
A User shall not be permitted to delete his or her GymFinder client account while an active gym registration exists under that User's email address in the GymFinderManager application. In this case, the only way to delete the account is through the GymFinderManager application.
V. Gym Operating Hours and Membership Plans
Users are solely responsible for verifying that the operating hours of any gym meet their scheduling requirements.
The Application does not adjust weekly or monthly membership plans based on gym operating hours.
VI. Fund Withdrawals for Gym Owners
Gym Owners shall not be permitted to withdraw funds to their bank accounts until such time as their gym ownership is duly verified in accordance with the Application's verification procedures.
A minimum account balance of $100 is required to authorize any withdrawal to a bank account.
The conversion from USD into the Gym Owner's local currency shall be effected using the exchange rate prevailing at the time the withdrawal is processed.
VII. Platform Fees
GymFinder shall impose a platform fee of 15% on session or membership prices charged to Gym Owners.
Users shall be subject to an order execution fee of $0.50 per transaction.
VIII. Gym Ownership Verification and Misrepresentation
Gym Owners must provide valid documentation verifying their ownership and the location of the gym as part of the verification process.
In the event that it is determined that an account was created by an individual who is not the legitimate owner of the gym, such account will be suspended immediately, and all funds held therein will be retained by GymFinder as liquidated damages for the breach of this Agreement.
GymFinder reserves the right to pursue all available legal remedies against any party found to have misrepresented their ownership or submitted fraudulent information.
IX. Health Declaration
Prior to purchasing any pass to a facility, users are required to complete the in-app health declaration form.
Users must provide truthful and accurate information on the health declaration form.
In case a User provides false or misleading information, all passes shall be canceled without refund, the User's account may be permanently terminated, and GymFinder reserves the right to pursue further legal action.
The health declaration form provided by GymFinder is for generic informational purposes only, and GymFinder disclaims any responsibility for its accuracy or adequacy. Gym Owners are solely responsible for supplementing this form with any additional health requirements as necessary.
GymFinder is a marketing platform, not a fitness provider; it offers no training advice and bears no responsibility for gym premises, instructors, insurance, or licences.
X. Refund Policy
Users shall be eligible for a full refund solely in instances where the information provided regarding a gym—specifically its location, operating hours, or existence—is determined to be misleading or inaccurate.
No refunds shall be granted for any reason other than the misrepresentation of gym information.
Refunds shall not be available for tickets that have been used at least once. For weekly and monthly membership tickets, no refund shall be issued once the ticket has been used for the first time, regardless of the remaining validity period.
Some gyms enforce age restrictions; Users may be required to present a valid photo ID to verify age upon entry. It is the User's sole responsibility to confirm any age-related requirements before purchasing a ticket, and no refund will be provided if a User is denied entry due to not meeting age requirements.
Upon approval of a refund request under the conditions set forth herein, the relevant ticket shall be immediately canceled, and the refund process will proceed in accordance with GymFinder's refund procedures and will take up to 3 working days.
XI. Ticket Usage
A one-time ticket, once scanned and redeemed, shall be deemed used and shall not be reissued or refunded.
Weekly memberships permit unlimited access for seven (7) consecutive days, inclusive of weekends and holidays, commencing from the date of purchase.
Monthly memberships permit unlimited access for thirty (30) consecutive days, inclusive of weekends and holidays, commencing from the date of purchase.
In the event that a purchased ticket expires without use, GymFinder reserves the right to retain the full amount without the obligation to issue a refund.
XII. Indemnification
Users and Gym Owners agree to indemnify, defend, and hold harmless GymFinder, its affiliates, and their respective employees, agents, and representatives from and against any and all claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from or in connection with their use of the Application, including, without limitation, any claims related to personal injuries, disputes, or financial losses.
XIII. Privacy and Data Security
GymFinder is committed to protecting the privacy and security of Users' personal information. All personal data collected through the Application shall be managed in accordance with applicable data protection laws and GymFinder's Privacy Policy, which is incorporated herein by reference.
XIV. Data Integrity and Validity
Users and Gym Owners are required to provide truthful and accurate information, including but not limited to email addresses and bank account details.
If any User or Gym Owner provides false, misleading, or inaccurate information, whether accidentally or intentionally, GymFinder reserves the right to take the following actions:
For Gym Owners: Retain all funds held in the account as liquidated damages for the breach of this Agreement.
For Users: Cancel all active tickets without refund.
GymFinder reserves the right to pursue all available legal remedies against any party found to have misrepresented critical account information.
XV. Amendments to Terms and Conditions
GymFinder reserves the right to modify or amend this Agreement at any time, with or without prior notice.
Continued use of the Application following such modifications shall constitute acceptance of the revised terms.
XVI. Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of [Your Country/State].
Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts located in [Your City/State].

Acknowledgment
By creating an account or accessing the Application, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. Non-compliance with any provisions of this Agreement may result in the suspension or termination of your account and/or the imposition of legal remedies by GymFinder.
